1. INTRODUCTION
This Privacy Policy describes how The Next Watchlist LLC, a Florida limited liability company ("Company," "we," "us," or "our"), collects, uses, discloses, and protects your information when you visit or use our website, social media channels, and any other services that link to this Privacy Policy (collectively, the "Site").
The Company provides business consulting and advisory services, and the Site serves as an informational and communications channel through which prospective clients can learn about our services, submit inquiries and applications, and communicate with us.
By accessing or using the Site, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our policies and practices, please do not use the Site. This Privacy Policy is incorporated into and forms part of our Terms and Conditions.
We may update this Privacy Policy from time to time. The updated version will be indicated by a revised "Last Updated" date and will be effective as soon as it is accessible. Your continued use of the Site after any changes constitutes your acceptance of the revised Privacy Policy.

2.1 Information You Provide Directly
Contact and Identity Information: Name, email address, phone number, company name, job title, and similar identifiers, such as when you submit an inquiry, fill out an application or intake form, schedule a consultation, subscribe to communications, or contact us.
Business and Application Information: Information about you and your business that you choose to provide when applying for or inquiring about our consulting services, which may include descriptions of your business model, products and services, revenue and financial performance, marketing channels, team structure, goals, and challenges. You control what you submit; please do not submit trade secrets, highly sensitive information, or information about other individuals without authorization, particularly before any confidentiality agreement is in place.
Communications: The contents of messages you exchange with us, including emails, contact form submissions, scheduling requests, direct messages on social media platforms, call and video conference communications (and, where permitted by law and with any required notice or consent, recordings or transcripts of such calls), survey responses, and other correspondence.
Engagement and Transaction Information: If you become a client, we may collect information necessary to negotiate, document, and perform an engagement, including billing details, entity and ownership information, and information required for equity or compensation arrangements. Information governed by an executed engagement agreement, including any confidentiality terms, is handled in accordance with that agreement in addition to this Privacy Policy.
Payment Information: If and when payments are processed in connection with our services, billing name, billing address, and payment method details may be collected by our third-party payment processors. We do not store full payment card numbers on our own systems.
2.2 Information Collected Automatically
When you visit the Site, we and our service providers may automatically collect:
Device and Browser Information: IP address, browser type and version, device type, operating system, language preferences, and device identifiers.

3. HOW WE USE YOUR INFORMATION
We use the information we collect for the following purposes:
Evaluating and Responding to Inquiries: To review applications and inquiries, assess potential engagements, perform due diligence on prospective clients and their businesses, schedule and conduct consultations, and communicate with you about our services.
Providing Services: To negotiate, document, perform, and administer consulting engagements, including invoicing, payment processing, and the documentation of compensation arrangements.
Marketing and Communications: To send you newsletters, updates, and promotional materials about the Company and its services, where permitted by law. You may opt out of marketing communications at any time using the unsubscribe link in our emails or by contacting us.
Analytics and Improvement: To analyze Site usage, measure the effectiveness of our content and outreach, and improve the Site and our services.
Legal and Safety Purposes: To comply with applicable laws, regulations, legal processes, and governmental requests; to establish, exercise, or defend legal claims; to enforce our Terms and Conditions and other agreements; to detect, prevent, and address fraud, security issues, and technical problems; and to protect the rights, property, and safety of the Company, our clients, and others.
Business Operations: To maintain business records, manage our client relationships, and operate in connection with any merger, acquisition, financing, reorganization, or sale of all or part of our business.
With Your Consent: For any other purpose disclosed to you at the time we collect the information or with your consent.
We may aggregate, de-identify, or anonymize information so that it can no longer reasonably be linked to you, and we may use and disclose such information for any lawful purpose, including in case studies or marketing materials, provided that identifiable client information will not be used in public case studies or testimonials without consent or as permitted under an applicable agreement.
4. HOW WE SHARE YOUR INFORMATION
We do not sell your personal information for money, and we do not share your personal information with third parties for their own direct marketing purposes. To the extent our use of analytics or advertising cookies could be considered a "sale" or "sharing" under certain state privacy laws, Section 9 describes your right to opt out.
We may share your information in the following circumstances:
Service Providers: We share information with third-party vendors that perform services on our behalf, such as website hosting, email and marketing platforms, CRM systems, scheduling and video conferencing tools, payment processing, document signature services, cloud storage, analytics, and professional services such as accounting and legal counsel. Professional Advisors: We may share information with our attorneys, accountants, and other professional advisors in connection with evaluating, negotiating, documenting, or performing engagements, or in connection with legal compliance and the protection of our interests.
Legal Compliance and Protection: We may disclose information if required to do so by law or in the good faith belief that such action is necessary to comply with legal obligations, respond to lawful requests from public authorities, enforce our agreements, or protect the rights, property, or safety of the Company, our clients, or the public.
Business Transfers: If the Company is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of its assets, your information may be transferred as part of that transaction. We will take reasonable steps to ensure the recipient honors the commitments in this Privacy Policy or provides you with notice of material changes.
With Your Consent: We may share your information for any other purpose with your consent or at your direction.
Information you share with us about your business in connection with an inquiry or engagement is used for evaluating and performing that engagement and is not shared with other clients or third parties except as described in this Privacy Policy or in an applicable agreement between us.
5. SOCIAL MEDIA AND THIRD-PARTY PLATFORMS
The Company maintains accounts and publishes content on third-party platforms. When you interact with our content or accounts on those platforms, your information is collected and processed by the platform operator under its own privacy policy, in addition to any information we receive as described above. We do not control the data practices of these platforms and encourage you to review their privacy policies.
6. COOKIES AND TRACKING TECHNOLOGIES
We and our service providers use cookies and similar technologies for the following purposes:
Strictly Necessary: Technologies required for the Site to function, such as security and remembering your preferences.
Analytics and Performance: Technologies that help us understand how visitors use the Site and how they arrive at our content, such as Google Analytics or similar tools.
Functionality: Technologies that remember your choices and enhance your experience, such as scheduling and form tools.
Advertising and Measurement: If we run advertising campaigns, technologies that measure campaign performance and may be used to deliver or measure advertising on or off the Site.

Do Not Track and Opt-Out Preference Signals: Because there is no industry standard for responding to "Do Not Track" signals, we do not currently respond to them. However, where required by applicable state law, we will treat recognized opt-out preference signals, such as the Global Privacy Control (GPC), as a valid request to opt out of any sale or sharing of personal information for the browser or device sending the signal.
7. EMAIL MARKETING AND COMMUNICATIONS
If you provide your email address through the Site, an inquiry, or another interaction, we may send you communications about the Company, its services, and related content. Every marketing email we send includes an unsubscribe link, and you may opt out at any time in accordance with applicable law, including the CAN-SPAM Act. Even after you opt out of marketing emails, we may still send you transactional or administrative communications, such as responses to your inquiries, scheduling confirmations, engagement-related correspondence, invoices, or notices about changes to our terms or policies.
8. DATA RETENTION
We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to evaluate and perform engagements, comply with legal, tax, and accounting obligations, resolve disputes, enforce agreements, and maintain business records. Information related to executed engagements, including equity and compensation arrangements, may be retained for extended periods consistent with corporate recordkeeping requirements and statutes of limitations. When personal information is no longer needed, we will delete it, de-identify it, or securely store it and isolate it from further processing until deletion is possible.
9. YOUR PRIVACY RIGHTS
Depending on where you live, you may have some or all of the following rights with respect to your personal information. We will honor rights requests as required by the law applicable to you.
9.1 United States State Privacy Rights
If you are a resident of a U.S. state with a comprehensive privacy law (including, for example, California, Florida, Colorado, Connecticut, Virginia, Texas, Oregon, and others), you may have the right to:
Know and Access: Request confirmation of whether we process your personal information and access a copy of it.
Correct: Request correction of inaccurate personal information.
Delete: Request deletion of personal information we have collected from you, subject to legal exceptions, including our need to retain information related to contracts, legal obligations, and the defense of legal claims.
Portability: Receive a copy of your personal information in a portable and readily usable format.
Opt Out: Opt out of (a) any sale of personal information, (b) any sharing or processing of personal information for targeted advertising, and (c) certain profiling activities. You may exercise this right by using any cookie preference tools we provide, enabling the Global Privacy Control in your browser, or contacting us as described in Section 14.
Non-Discrimination: Not receive discriminatory treatment for exercising your privacy rights.
Appeal: In certain states, appeal our denial of a rights request by contacting us with the subject line "Privacy Appeal."
Florida Residents: Regardless of whether the Company currently meets the statutory thresholds for coverage under the Florida Digital Bill of Rights, we voluntarily extend the access, correction, deletion, and opt-out rights described above to Florida residents.
California "Shine the Light": California residents may request information about disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
Please note that some rights, such as deletion, may be limited where the information is necessary to perform a contract with you or your business, to comply with legal obligations, or to establish, exercise, or defend legal claims, which is particularly relevant to information connected to consulting engagements and equity arrangements.
9.2 European Economic Area, United Kingdom, and Other International Users
If you are located in the European Economic Area, United Kingdom, Switzerland, or another jurisdiction with similar data protection laws, the following additional terms apply:
Legal Bases: We process your personal information on the following legal bases: (a) performance of a contract or steps taken at your request prior to entering a contract, such as evaluating your application and performing an engagement; (b) legitimate interests, such as operating and improving the Site, marketing our services, conducting due diligence, securing our systems, and managing our business, balanced against your rights and interests; (c) consent, where required, such as for non-essential cookies or certain marketing; and (d) legal obligation, where processing is necessary to comply with applicable law.
Your Rights: You may have the right to access, rectify, erase, restrict, or object to the processing of your personal information, the right to data portability, and the right to withdraw consent at any time without affecting the lawfulness of processing before withdrawal. You also have the right to lodge a complaint with your local data protection supervisory authority.
International Transfers: The Site is operated from the United States, and your information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those of your jurisdiction. Where required, we rely on appropriate safeguards for such transfers, such as standard contractual clauses, or on your consent or the necessity of the transfer to perform our agreement with you or take steps at your request prior to entering into an agreement.

To exercise any of the rights described above, contact us using the information in Section 14. We may need to verify your identity before fulfilling your request. You may designate an authorized agent to make a request on your behalf where permitted by law; we may require proof of authorization and verification of your identity. We will respond to verifiable requests within the timeframes required by applicable law. We do not charge a fee for processing rights requests unless permitted by law for excessive or repetitive requests.
10. CHILDREN'S PRIVACY
The Site is intended for users who are at least 18 years of age. We do not knowingly collect personal information from anyone under the age of 18, including children under 13 in accordance with the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a person under 18, we will delete that information promptly. If you believe a minor has provided us with personal information, please contact us using the information in Section 14.
11. DATA SECURITY
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration, including limiting access to personal information, using reputable service providers, and applying security practices appropriate to the size and nature of our business and the sensitivity of the business information our clients and prospects share with us.
However, no method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security, and you provide information to us at your own risk. You are responsible for maintaining the confidentiality of any credentials associated with your interactions with us and for notifying us promptly of any suspected unauthorized access.
12. THIRD-PARTY WEBSITES AND SERVICES
The Site may contain links to third-party websites, tools, and services. This Privacy Policy does not apply to third-party websites or services, and we are not responsible for their privacy practices. We encourage you to review the privacy policy of every website you visit and every tool you use.
13. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or business operations. When we make changes, we will revise the "Last Updated" date at the top of this Privacy Policy. If we make material changes, we will provide notice as required by applicable law, such as by posting a prominent notice on the Site or, where appropriate, contacting you directly. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Privacy Policy.
